IT'S ALL ABOUT THE APPROACH

We couple experienced realtors who are extremely confident in listing and marketing properties that are in the foreclosure stage with knowledgeable lawyers to handle the paperwork. After all, monitoring and pricing of such property is crucial to the sale being successful. Since it can take up to a few months in some cases, we inform and help any potential buyer know this so they are aware of the Indymac short sale process. 

  • Let's say the buyer decides the process is taking to take too long and walks away. Since the short sale process can take months to be finalized you can probably sympathize with the buyer. At this point is our job to see why they do not want to wait it out. In the meantime, we have been promoting your property to a backup contract in the event that the first buyer backed out.
  • Another issue that can arise is the over valuing of the property.  The property might have been evaluated or appraised at an unrealistic high price.  Thus the buyer might not wish to proceed with their purchase at all.  If and when this does occur, we then back up a lower price and suggest to the homeowner seek a certified appraisal. The lenders only require a BPO, or broker price opinion.  Indymac will pay a broker or another agent the fifty to eighty-five dollar fee to come evaluate the home. Although they are not always as accurate as a full scale appraisal which could cost upwards to three-hundred dollars. This one issue can stall the process. Our efforts are designed to find your property a buyer and keeping you out of foreclosure 
  • What about the back HOA fees?  The attorney’s office can sometime negotiate these and there are cases when Indymac will actually pay all or some of it for you.  Not a guarantee, but sometimes it is taking care of.  So it is safe to say that your best option is to continue paying your HOA fees and keep up with them.  If the lender doesn't want to pay them, and the HOA will not accept anything less and if the buyer doesn't want to pay either?  Well, then we are now in a standstill situation. Believe it or not properties have gone into foreclosure due to back HOA debts alone.



                                                         IMPERITIVE INFORMATION!

You will be seeing a lot through the website about payback or notes and we have to address this as well.  A note has become more of a reality and Indymac has seen more of them lately.  The property owners sign a payback plan note while in a short sale.  This doesn't mean full amount that is owed, but it does mean you need to be prepared.  Remember you might have to commit to it.  Under our new Obama plan it states there's a possibility you'll have to pay back nothing, however there is NO GUARANTEE!  But I'd rather sign a voluntary note rather than one that is court ordered.  This note is unsecured, what if you do not pay it?  Well, same thing that the credit companies do over a credit card debt.  They will send you to a collections agency and try to seek payment back.  So, you get the short sale over and you do not go into foreclosure.  Who wants to be the one to actually sign a note?  No many of us, but it can beat the alternative of foreclosure.  Remember that we explain this all upfront so you know that going into the short sale isn't all a nice bed of roses and in the end can be tough.  But the short sale is a way to help you to avoid going into foreclosure.  REMEMBER THIS; IF YOU FIND A COMPANY THAT STATES THEY CAN GUARANTEE THAT YOU WON'T HAVE TO PAY A NOTE OR FACE ANY FURTHER FINANCIAL LIABILITY, THEY ARE LYING TO YOU. NO COMPANY CAN CLAIM THAT UNLESS THEY CONTROL Indymac OF THE LEGAL SYSTEM.
